Highlights

The Army requested a decision concerning a retired member's claim for recomputation of his retired pay to reflect 4 years of reserve duty which he performed after his retirement from active service. GAO held that the claimant was not entitled to reserve-related retirement pay, since: (1) during most of his 4 years of reserve duty, he received retired pay and was not on reserve duty; and (2) the government was not bound by the erroneous advice that all his reserve time would be added to his 20 years of active duty at age 60. Accordingly, the claim was denied.
