[Protest of DLA Rejection of Bid as Nonresponsive]

A firm protested the rejection of its bid under a Defense Logistics Agency (DLA) solicitation for machine screws. DLA rejected the bid as nonresponsive because the protester failed to complete certain representations concerning small business manufacture of the required product. The protester contended that it was apparent from the bid that the screws would be manufactured by a small business. GAO held that: (1) the protester listed a small business as the manufacturer of the screws; (2) the protester's bid bound it to use that supplier; and (3) DLA could have ascertained from the bid that the screws would be manufactured by a small business. Accordingly, the protest was sustained, and GAO recommended that DLA make award to the protester.
