Highlights

A former Navy member appealed the Claims Group's denial of his claim for amounts representing accrued leave due him on the basis of a correction of his military records. The 1955 discharge status of the member was changed in 1981 from other than honorable to honorable conditions. As a result, the member claimed payment for days of unused leave accumulated at the time of his discharge. However, his claim was disallowed by the Claims Group because, in the intervening period, all Government records which would have established how many days of leave he had accrued at the time of his discharge were lost or destroyed. The burden of proof of entitlement absent the Government records was on the claimant, but he failed to furnish any evidence of the leave he had to his credit. Accordingly, his claim was denied and the Claims Group's settlement was sustained.
