[Entitlement of MSPB Employees to Retroactive Promotions]

GAO was asked to determine whether 18 employees of the Merit Systems Protection Board (MSPB) were entitled to retroactive promotions that were suspended due to a cut in the MSPB fiscal year 1982 appropriations. Of the 18 employees, 10 were selected for promotion before the effective date of the budget cut and 8 were entitled for promotion after that date. GAO stated that: (1) the 10 promotions were not improperly revoked before they became effective and are retroactively effective; and (2) the 8 promotions were properly revoked. Accordingly, there was no basis to allow retroactive promotions for the 8 employees.
