An opinion was requested concerning payment of attorney's fees under the Federal Trade Commission Act. The Federal Trade Commission (FTC) has discretion to determine eligibility for reimbursement of costs involved in participation in its rulemaking proceedings, including payment of reasonable attorney's fees. However, the FTC has no authority to pay an amount in excess of the expense actually incurred.
