Computation of Retired Pay for Officer Retiring on Disability

An advance decision was requested concerning computation of retirement pay of an officer who completed the minimum service time necessary for voluntary retirement and was retired at 40% disability in the same month. Since the officer was retired on disability before he could voluntarily retire, he could not use the voluntary retirement method of computing retirement pay and was not entitled to retirement pay under 10 U.S.C. 6323.
