Martha E. Albrecht, Director, Finance Department, Navy Regional Finance Center, Washington, D.C., requested an advance decision with regard to the use of military and annual leave by an employee whose regular workweek was other than Monday through Friday. A civilian employee whose regular workweek includes Sunday may not take military leave to attend weekend Naval Reserve drills. If the employee takes annual leave on Sunday, he may not receive overtime and differentials normally payable under military leave status. Although the employee was prevented from working overtime on a nonworkday because he attended military drill, he could not take annual leave to be eligible for overtime pay.
