Request for Waiver for Erroneous Payments of Proficiency Pay

A Navy member requested further consideration of his request for waiver of an indebtedness to the United States which resulted from erroneous payments of proficiency pay from July 7, 1971 through August 31, 1973. Waiver was denied for payments received after February 1972 since the member received monthly earnings statements which should have made him aware of the error in pay. However, for the period prior to March 1, 1972, the request for waiver was granted since the pay records indicated that there were significant fluctuations in the pay received after July 7, 1971. Since the member did not receive earnings statements during that time, it appeared reasonable to believe that he was not aware of the overpayment.
