Applicability of Davis-Bacon Act to Contracts for Both Construction and Nonconstruction Work

An interpretation was requested of a decision relating to the applicability of the Davis-Bacon Act to construction work performed under operation and maintenance contracts subject to the Service Contract Act. On contracts for both construction and nonconstruction work, contracting officers may follow applicable criteria of A.S.P.R. 12-106.1 which provide that the Davis-Bacon Act is applicable to contracts involving a substantial amount of construction work.
