Request for Waiver of Indebtedness Due to Erroneous Payment of Family Separation Allowance

A retired service member appealed a settlement which denied waiver of indebtedness arising from an erroneous payment of family separation allowance. The debt was properly not waived since the member knew that continued payment of the allowance after his return from an overseas assignment was improper. The fact that he notified proper authorities of the overpayment provided no basis for waiver of subsequent payments since he had a duty to set aside the payments for eventual return to the United States upon correction of the error.
