Federal Rulemaking: Selected Agencies Should Fully Describe Public Comment Data and Their Limitations

Wage and Hour Division The Administrator of WHD should fully describe available public comment data, including any limitations, to external users of the data. This should include coordination with GSA, as the manager of Regulations.gov, as appropriate. (Recommendation 9)

In November 2021, WHD stated that it will work with other impacted agencies and take appropriate steps to implement the recommendation in a coordinated manner. We will continue to monitor WHD's efforts in this area.

Wage and Hour Division The Administrator of the Department of Labor's Wage and Hour Division should ensure that the new data system under development includes mechanisms to prevent staff from assigning and prioritizing cases in a manner inconsistent with established policies. As of September 2022, Wage and Hour division continues to develop its new case management system. Wage and Hour Divisions plans to implement the new case management system over a couple of years by incrementally releasing modules, and anticipates releasing the main investigation module in late FY 2023 or early FY 2024. This module will contain a notification to alert staff of specific policy requirements for assigning and prioritizing cases.

Fair Labor Standards Act: Tracking Additional Complaint Data Could Improve DOL's Enforcement

Wage and Hour Division The Administrator of DOL's Wage and Hour Division should develop a method for systematically aggregating and reviewing data on the reasons that complaints recorded in its enforcement database have been filed with no compliance action and the reasons cases have been dropped. (Recommendation 1)
Open – Partially Addressed

DOL agreed with this recommendation and stated that it would address it by incorporating the ability to categorize, aggregate and review data on the reasons complaints are recorded and later declined or dropped into the enhancements to Wage and Hour Division's (WHD) new case management system. As of September 2022, WHD officials reported that its new system includes this functionality and WHD staff received guidance on it in July 2022. We will close this recommendation when this enhancement is fully implemented and WHD analyzes the additional data to determine why some complaints of wage
