Employment and Training Administration The Assistant Secretary for the Employment and Training Administration should take steps to target its audits of H-2B employers to employers with the highest likelihood of violating program requirements; such steps could include moving ahead with developing a system for identifying trends in H-2B employer audit outcomes. DOL agreed with this recommendation. DOL initially noted that while further development of a system for tracking industry and occupational trends in H-2B employer violations is on hold due to budgetary constraints, when this system is available it will provide the capacity to take a risk-based approach to selecting employers for audits. In FY2021, ETA began developing the new audit module within its Foreign Labor Application Gateway (FLAG) system. Employment and Training Administration The Assistant Secretary of ETA should develop, document, and implement a comprehensive strategy that (1) accounts for Job Corps' projected workload requirements and (2) considers its acquisition workforce needs—including the number of staff, skills, and other supports necessary to plan, award, and monitor Job Corps center contracts—to enable it to effectively plan for and competitively award future Job Corps center contracts. DOL stated that it implemented a comprehensive strategy accounting for Job Corps projected workload and acquisition workforce needs. Toward that end, DOL produced a list of the 28 Job Corps centers it plans to re-procure prior to their final option year, and workforce plans analyzing its overall workforce needs. We will close this recommendation when DOL provides additional documentation with more specific information on Job Corps' acquisition workforce needs.
