Recommendations Database
GAO’s recommendations database contains report recommendations that still need to be addressed. GAO’s priority recommendations are those that we believe warrant priority attention. We sent letters to the heads of key departments and agencies, urging them to continue focusing on these issues. Below you can search only priority recommendations, or search all recommendations.
Our recommendations help congressional and agency leaders prepare for appropriations and oversight activities, as well as help improve government operations. Moreover, when implemented, some of our priority recommendations can save large amounts of money, help Congress make decisions on major issues, and substantially improve or transform major government programs or agencies, among other benefits.
As of October 25, 2020, there are 4812 open recommendations, of which 473 are priority recommendations. Recommendations remain open until they are designated as Closed-implemented or Closed-not implemented.

GAO-20-36, Dec 5, 2019
Phone: (202) 512-8777
Agency: Department of Homeland Security: United States Immigration and Customs Enforcement
Status: Open
Comments: In November 2019, ICE DHS did not concur with this recommendation, stating that ICE did not have any requirement or need to aggregate data on detained parents or legal guardians of U.S. citizens and legal permanent resident minors and doing so would not better inform ICE's decision-making processes. In a May 2020 update, ICE noted that ICE Enforcement and Removal Operations (ERO) officers continue to collect and maintain information in EARM and EAGLE regarding whether an alien is a parent, or legal guardian, of a U.S.-born citizen or legal permanent resident minor for actions specific to individual cases; and that this case-specific information is readily available to approved EARM users, including Child Welfare Coordinators. However, as we noted in our report, these data are not readily available because ICE's data on family relationships, including parents or legal guardians of U.S. citizens and legal permanent resident minors, can only be accessed by manually reviewing each separate case file in EARM. Further, ICE's policy states that in pursing the enforcement of U.S. immigration laws against parents of minors, ICE personnel should remain cognizant of the impact enforcement actions may have on U.S. citizen or legal permanent resident minors. Without making these data readily available, ICE is not able to account for the overall impact of its enforcement actions on U.S. citizen or legal permanent resident minors whose parents or legal guardians have been detained. In its May 2020 update, ICE also noted that ERO provided Congress with the report, "Deportation of Parents of U.S.-Born Children," incorporating the first half of calendar year 2019, in April 2020. However, as we noted in our report, to generate this semi-annual required report to Congress on removals of parents of U.S.-born citizen children, ICE must review this information manually. Also, there is no similar requirement to report in an aggregate way on parents of U.S. citizen or legal permanent residents who are detained. We continue to believe that collecting and maintaining information in a readily available format on detained parents or legal guardians of U.S. citizen or legal permanent resident minors could help ensure that ICE personnel can identify, evaluate, and share information on this population, as required by ICE policy.

Comments: The Office of the Director of National Intelligence (ODNI) concurred with this recommendation. In its August 2020 response, ODNI noted that in preparation for the transition of the Intelligence Community Centers for Academic Excellence (IC CAE) program from the Defense Intelligence Agency to ODNI, the ODNI commissioned an independent study in 2019 to assess program performance and barriers to success. ODNI noted that this study, in conjunction with the GAO report, are informing the development of a program strategy and sound business practices that will prescribe goals and measurable objectives. These efforts are expected to be completed in late 2020, at which time ODNI plans to develop a companion Strategic Implementation Plan that will set the foundation for behavior and reporting criteria across all IC CAE grant-receiving institutions, legacy schools, and stakeholders. ODNI noted that the plan which is expected to be completed in the third quarter of fiscal year 2021, will include an annual evaluation process linked to survey results and documented lessons learned. We will continue to monitor the status of this recommendation.

Comments: The Office of the Director of National Intelligence (ODNI) concurred with this recommendation. In its August 2020 response, ODNI noted that was in the process of developing an engagement strategy for the reintegration of Intelligence Community Centers for Academic Excellence (IC CAE) legacy schools to ensure prior investments are capitalized on and to maximize outreach efforts. ODNI also noted that it is routinely leveraging multiple interagency IC-wide working groups to engage with IC elements and stakeholders to increase its understanding of barriers to engaging with IC CAE, as well as to develop a community-wide understanding of the benefits associated with engagement. ODNI plans to include the results in the Strategic Implementation Plan, which it expects to complete in the third quarter of fiscal year 2021, and noted that it will routinely update these efforts to ensure best practices are being implemented. The ODNI stated that it will use this ongoing process and dialogue to assess and seek to address such barriers and to improve ongoing IC element participation. Comments: HHS concurred with this recommendation. HHS' Behavioral Health Coordinating Council finalized a plan for implementing the Strategy in 2019 . The plan includes priorities, timeframes, and clear roles and responsibilities for implementing NAS-related recommendations in the Strategy. The plan does not specifically identify methods for assessing progress on the recommendations, but HHS officials told us in November 2019 that the department holds quarterly conference calls to share updates and formal written updates will be collected at the end of each year. To close this recommendation, HHS needs to provide documentation-such as, the formal written updates-to show how the department assesses progress on the recommendations.

Comments: The Federal Retirement Thrift Investment Board (FRTIB) did not concur with this recommendation. In July 2020, FRTIB officials told us they expect to award the mutual fund window contract in the last quarter of 2020 and that one of the goals in offering the mutual fund window is to ensure that Thrift Savings Plan participants have a variety of funds from which to choose. However, FRTIB has not changed its position on the recommendation. We continue to believe that the recommendation is valid and will monitor FRTIB's efforts to address it.

Comments: As of June 2017, VHA still lacks data and performance measures for the availability under Choice of sex-specific care, such as mammograms, maternity care, or gynecology. In contrast, for another VA care in the community program, PC3 (a program that the Choice third party administrators also administer) VHA collects data and has performance measures to evaluate women veterans' access to mammography and maternity care. To fully implement this recommendation, VHA needs to extend the collection of data to include care delivered through the Choice Program and other community care programs and establish related performance measures. VA is in the process of letting contracts for its new community care program and is expected to have contracts in place for all regions of the country in fiscal year 2019

Comments: At the time of our report, OMB neither agreed nor disagreed with this recommendation but stated that it did not believe convening a forum was the most strategic use of resources because agencies were not far enough along with their data collection efforts. We disagree with OMB's assertion because 7 of the 10 data collection efforts have been in place for more than 10 years, and several have been in place for multiple decades. As of December 2019, OMB has not provided information on any new efforts to establish a federal interagency forum on sexual violence statistics.

Comments: The Department of Education (Education) concurred with this recommendation. In February 2020, Education told us that it had awarded three grants that, while not focused on FGM/C, may be used for student safety and health at the U.S. state and local levels. After it evaluates grantees' need for information and resources related to FGM/C, Education will determine its next steps. In addition, Education reported that it continues to participate on the federal interagency workgroup devoted to FGM/C and has dedicated program staff to respond to issues related to FGM/C. Education expects to finalize its written plan by August 2020.

Agency: Department of Energy
Status: Open
Comments: DOE generally agreed with this recommendation. DOE's Office of Science began collecting investigator demographics during the second quarter of fiscal year 2015 and already retained complete records that enabled the calculation of success rates. According to DOE officials, since September 2017, the other three grant-making components included in our audit have been taking various actions to implement the recommendation. These three components, the Office of Nuclear Energy (NE), the Advanced Research Projects Agency-Energy (ARPA-E), and the Office of Energy Efficiency and Renewable Energy (EERE), all complete steps to ensure that they retain complete grant life cycle information for each individual award, including complete records of pre-proposal, proposal, and award data in linked electronic files, thus fulfilling the first part of our recommendation. In 2019, EERE coordinated the development of a Federal Register Notice (FRN) regarding data collection jointly with NE and ARPA-E. The FRN drafted by EERE was finalized and published on February 11, 2020 (Vol. 85, Issue 28, Pages 7759-7760 [FR DOC# 2020-02674]). Under the proposed information collection request, an interface will be implemented in DOE grant application systems to allow external users to voluntarily provide a minimal amount of demographic information to comply with this recommendation, pursuant to review by the Office of Management and Budget. On June 30th, DOE officials shared with GAO the draft FRN for the 30-day notice and request for public comment prior to implementation.

Comments: DOD agreed with this recommendation and noted it is in the process of revising current DOD guidance which will address its Title IX enforcement requirements. In September 2017, a DOD official stated that the agency is in the process of formulating instructions related to both Title IX and Title VI that they believe will address the recommendation regarding Title IX enforcement. In a memorandum issued in December 2017, a DOD official described the agency's corrective action plan (CAP), including drafting an updated rule for the Code of Federal Regulations and the development and issuance of internal DOD policy documents regarding Title IX enforcement requirements. Both of these activities were expected to be completed by June 2019. DOD reported in March 2020 that it is continuing to revise current DOD guidance to address its Title IX enforcement requirements. The Director of DOD's Office of Diversity, Equity, and Inclusion (ODEI) stated in a letter to GAO that the revised Titile IX policy is in the early stages of DOD's policy process. ODEI expressed its commitment to developing the revised policy and ensuring Title IX compliance reviews are conducted as per the revised policy and GAO's recommendation. In September of 2020, DoD sent an update indicating that they will issue a policy memorandum, specifically outlining the requirement for DoD Components who provide financial assistance to educational programs or activities conduct periodic compliance reviews. This is expected to be complete by December 31, 2020.

Comments: DOD concurred with our recommendation and stated that leadership accountability is essential to the success of the department's efforts to prevent sexual harassment. In February 2018, DOD took action toward addressing this recommendation and released an update to DOD Instruction 1020.03, Harassment Prevention and Response in the Armed Forces, that directs the Director, Office of Diversity Management and Equal Opportunity (ODMEO), to ensure that DOD components' harassment prevention and response programs incorporate, at a minimum, compliance standards for promoting, supporting, and enforcing polices, plans, and programs. The updated instruction also directs the Commandant, Defense Equal Opportunity Management Institute (DEOMI), to tailor training materials to servicemember professional development levels and associated leadership duties and responsibilities. As of February 2020, DOD had not completed development of the compliance standards or training materials. We will monitor DOD actions on this issue.

Comments: DOD has updated its guidance on sexual harassment, including a requirement for sharing the results of command climate assessments with the next higher level of command, but has not yet implemented an oversight mechanism to verify and track commanders' compliance with requirements to conduct such assessments. DOD concurred with this recommendation and stated that it would implement the recommendation through revisions to its guidance. According to DOD, a 2013 memorandum from the Secretary of Defense on sexual assault prevention and response outlined requirements addressing leadership accountability for preventing sexual harassment. The memorandum included a requirement that the results of command climate surveys be provided to the next level up in the chain of command, and it directed service chiefs, through their respective military department secretaries, to develop methods to assess the performance of commanders in establishing command climates of dignity and respect. The Secretary of Defense also issued a memorandum addressing prevention and response of sexual harassment in 2014, and DOD updated its guidance on sexual harassment in 2015. In 2016, DOD stated that further revisions to guidance were forthcoming to provide a framework for oversight of sexual harassment. This framework, among other things, would address standards for holding leaders accountable for promoting, supporting, and enforcing sexual harassment policies. DOD issued a new DOD Instruction 1020.03, Harassment Prevention and Response in the Armed Forces, in February 2018 but has not implemented an oversight framework as of February 2020. We will continue to monitor DOD's actions.

Comments: DOD concurred with our recommendation and stated that as part of its revised guidance it proposed to strengthen and institutionalize the responsibilities and authorities needed for successful implementation of the department's sexual harassment policies. In February 2018, DOD took action toward addressing this recommendation and issued an update to DOD Instruction 1020.03, Harassment Prevention and Response in the Armed Forces, that directs the Director, Office of Diversity Management and Equal Opportunity, to ensure that DOD components' harassment prevention and response programs incorporate , at a minimum, (1) long-term goals, objectives, and milestones; (2) results-oriented performance measures to assess effectiveness; and (3) compliance standards for promoting, supporting, and enforcing policies, plans, and programs. As of February 2020, DOD has not developed and aggressively implemented an oversight framework, as we recommended. We will continue to monitor DOD's actions.

Comments: FHWA has taken initial steps to implement a mechanism for state oversight, which includes collecting program implementation information from each state. FHWA plans to convene a working group to review this information and provide feedback to states on their programs. FHWA officials then anticipate sharing best practices and essential requirements for the program through webinars and other technical assistance. As of August 2019, FHWA has gathered information from states and is in the early stages of implementing this oversight mechanism.
