Comments: In June 2020, DOE officials told us that its Office of Environmental Management (EM) Portsmouth/Paducah Project Office (PPPO) is in the process of developing a program management master plan, to include site-integrated master schedules and life-cycle cost estimates, for the Portsmouth and Paducah gaseous diffusion plants (GDPs). Officials stated that the plan will incorporate program management leading practices as appropriate. According to DOE officials, EM will direct PPPO to use actual collected cost and schedule information for integration of relevant lessons learned from ETTP cleanup into integrated program plans, schedules, and estimates. DOE officials estimated that this effort would be completed by December 31, 2020.

Recommendation: The Secretary of Energy should direct the Assistant Secretary of the Office of Environmental Management to track consistent and detailed expenditure information on cleanup activities across the three GDPs. (Recommendation 2)

Comments: In June 2020, DOE officials told us that its Office of Environmental Management (EM) is assessing and identifying an appropriate mechanism for tracking expenditures for both the Portsmouth and Paducah GDP sites, using a standardized approach with an Earned Value Management System (EVMS) reporting on, at a minimum, an annual basis. According to DOE officials, PPPO is in the process of using the ETTP data as a basis of comparison for contractor estimates and assessing the potential development of cost estimating tools for independent cost estimating. DOE officials estimated that this effort would be completed by December 31, 2020.

Recommendation: The Secretary of Energy should direct the Assistant Secretary of the Office of Environmental Management to ensure the site-specific life-cycle cost estimates for the cleanup of each of the GDPs fully incorporate best practices for cost estimation. (Recommendation 3)

Comments: In June 2020, DOE officials told us that its Office of Environmental Management (EM) has directed the Portsmouth and Paducah GDP sites to review and incorporate the practices from GAO's Cost Estimating Guide (GAO-20-195G), as appropriate, into the next revision of each site's life-cycle cost baselines. According to DOE officials, Oak Ridge is in the process of procuring a follow-on cleanup contract, which includes the scope to complete the cleanup of ETTP. According to DOE officials, given that the cleanup of the ETTP GDP is nearly complete, the baseline for the entire ETTP GDP will not be included in the life cycle cost estimate review. Officials stated the remaining scope of work for the ETTP GDP will, however, become part of the performance baseline for the next Oak Ridge cleanup contractor. DOE officials estimated that this effort would be completed by December 31, 2020.

Recommendation: The Secretary of Energy should direct the Assistant Secretary of the Office of Environmental Management to work—in conjunction with EPA and Kentucky and Tennessee state regulators—with an independent, third-party facilitator to help resolve disagreements over cleanup priorities, cleanup remedies, and cost estimation assumptions. (Recommendation 4)

Comments: In June 2020, DOE officials told us that its Office of Environmental Management (EM) has incorporated the use of an independent facilitator on a case-by-case basis to help resolve any disagreements, in conjunction with the Environmental Protection Agency (EPA), and Kentucky and Tennessee state regulators over cleanup priorities, remedies, and cost estimation assumptions. Officials stated that most recently, the Paducah GDP site used an independent facilitator to resolve disagreements with EPA Region IV and Kentucky state regulators. According to DOE officials, in the future, EM will continue the use of an independent facilitator, as deemed appropriate. DOE officials estimated that this effort would be completed by December 31, 2020.

Recommendation: The Secretary of Energy should regularly report on the status of the D&D Fund and cleanup efforts at the three GDPs with current information that contains details on challenges in reaching agreement with regulators and a clear scope of work. (Recommendation 5)

Officials stated that the report is being circulated for approval. DOE officials estimated that this effort would be completed by December 31, 2020.

Recommendation: The Director of the Office of Management of Budget should update the Guidelines to include GAO's leading practices of developing monitoring plans that are based on risks, ensuring that monitoring staff have appropriate qualifications, establishing procedures to close-out programs, developing staff skills regarding evaluations, and establishing mechanisms for following up on evaluation recommendations. (Recommendation 1)

Comments: OMB disagreed with the recommendation and suggested it would be more effective to remind agencies that, in addition to the guidelines, they should follow all other relevant OMB guidance affecting monitoring and evaluation. OMB asserted that this guidance contains provisions relevant to our leading practices not included in the Foreign Assistance Monitoring and Evaluation Guidelines. However, we believe it is important for OMB to incorporate this other guidance into the Foreign Assistance Monitoring and Evaluation Guidelines, if only by reference, to emphasize the importance of these practices in the context of monitoring and evaluation of foreign assistance. As of April 28, 2020, the Office of Management and Budget has not implemented this recommendation. GAO will continue to monitor this issue.

Recommendation: The Secretary of Defense should update the Department's monitoring and evaluation policies to require the agency to conduct impact evaluations on all pilot programs before replicating or expanding, or conduct performance evaluations for those programs and provide a justification for not conducting an impact evaluation. (Recommendation 5)

Comments: DOD partially concurred with this recommendation and noted that impact evaluations require a significant resource investment beyond what would be appropriate for more programs. However, DOD is in the process of updating its evaluation guidelines to allow for, but not require, impact evaluations in appropriate cases at all levels of evaluation activities.

Recommendation: The Department of State's U.S. Global AIDS Coordinator, in collaboration with HHS and other implementing agencies, should update the PEPFAR monitoring and evaluation policies to require these agencies to conduct impact evaluations on all pilot programs before replicating or expanding, or conduct performance evaluations for those programs and provide a justification for not conducting an impact evaluation. (Recommendation 6)

Comments: State agreed with the intent of the recommendation (see appendix V for written comments). State explained that impact evaluations are often not feasible in the context of assistance provided under PEPFAR and described its alternative approach to evaluating new initiatives. State indicated it would update appropriate PEPFAR policies to clarify when agencies should conduct impact and/or performance evaluations. These clarifications will reflect how State evaluates PEPFAR programs in practice in accordance with OMB guidance and legislation, according to State.

Recommendation: Congress should consider amending the law to provide the Secretary of the Treasury with the authority to alter the metal composition of circulating coins if the new metal compositions reduce the cost of coin production and do not affect the size, weight, appearance, or electromagnetic signature of the coins. Comments: As of July 2020, the Currency Evolution Now to Save Act (the CENTS Act) has been introduced in the Senate. This bill authorizes the Department of the Treasury to prescribe a different composition of materials in the half-dollar, quarter-dollar, dime, or five-cent coin if such action reduces the overall cost of minting the coin and does not affect (1) the diameter and weight of the coin; or (2) the functionality of the coin, including the electromagnetic signature for accepting it.

Recommendation: We recommend that the Director, DCMA, in collaboration with the Director, DCAA, develop a mechanism to monitor and assess whether contractor business systems reviews are being completed in a timely manner. (Recommendation 1)

Comments: DCMA concurred with our recommendation and the department notified us in March 2019 that collaboration between DCMA and DCAA to develop a mechanism to increase oversight and improve management of contractor business system audits and determinations had begun. In September 2019, DCMA and DCAA provided lists of the business system reviews planned to be conducted during fiscal year 2020, showing that the data needed for oversight of all CBS reviews is available between the two agencies. Further, an April 2019 DCMA memorandum indicated that DCAA data on planned reviews for fiscal years 2019 and 2020 had been transferred to DCMA and that administrate contracting officers were to conduct risk assessments to identify additional reviews for DCAA to complete in the future. In August 2020, DCMA and DCAA specified the sources of the data provided earlier; DCAA data is collected through its strategic workload and resource initiative and inputted into the DCAA Management Information System while DCMA business system review data continues to be maintained by the functional offices responsible for those reviews. Both agencies stated that progress against planned reviews is tracked and status is reported to management at regular intervals. DCMA also noted a series of new tools designed to enhance surveillance of contractor business systems and implementation of corrective actions. These steps indicate progress towards increased insight into both the completion CBS review and the follow-up that occurs afterward. However It remains unclear to what extent data sharing between DCAA and DCMA to support CBS review planning has been formalized and will continue or the extent to which DCMA headquarters uses this data to assess implementation of its policies for the conduct of CBS reviews.

Recommendation: Once reliable data are available, the Coast Guard, or another agency identified by the working group, should assess the rates of commercial fishing vessel accidents, injuries, and fatalities to determine whether certain factors--including vessel length and region of operation, among other things--affect these rates. (Recommendation 3)

Comments: The Department of Homeland Security (DHS) did not concur with our recommendation that the Coast Guard assess the rates of commercial fishing vessel accidents, injuries, and fatalities to determine whether certain factors-such as vessel length and region of operation-affect these rates. DHS officials stated that the Coast Guard has limited resources and capabilities to conduct such assessments and noted that the National Institute for Occupational Safety and Health (NIOSH) studies marine incidents to identify causal factors in fishing vessel casualties, which could more effectively determine casualty rates. The Coast Guard uses this information to update and develop commercial fishing vessel safety standards and policy, as appropriate. GAO agrees that NIOSH plays an important role in identifying commercial fishing fatalities and regional risk factors, but such assessments typically focus on fatalities in specific fisheries, and generally did not consider such factors as vessel length or whether the vessel has been classed. As of July 2020, Coast Guard officials stated the Coast Guard continues to work with other Federal partners on data collection strategies through the established work group to determine the best reliable data in order to establish credible rates of casualties, injuries, and fatalities in the commercial fishing vessel industry. This recommendation will remain open pending a decision by the working group on the appropriate agency to conduct these assessments.

Recommendation: The Coast Guard should issue regulations or guidance to clarify and implement the alternative-to-class approach. (Recommendation 4)

Comments: The Department of Homeland Security concurred with our recommendation that the Coast Guard issue regulations or guidance to clarify and implement the alternative-to-class approach. As of November 2018, the Coast Guard made a presentation to the commercial fishing industry clarifying the alternative-to-class approach as it relates to commercial fishing vessels including discussion topics such as understanding the language of 46 USC 4503 and State Licensed Naval Architect and Marine Engineers' scope of responsibilities when incorporating standards equivalent to those prescribed by a classification society. As of June 2020, Coast Guard officials stated they have formalized work instruction guidance regarding implementation of the alternative-to-class approach. This guidance is expected to be released by the end of 2020.

Recommendation: To promote further transparency in measuring the federal government's progress against deficit reduction targets required under current law, the Director of the Office of Management of Budget should identify and publicly report the total amount of actual reductions in budget authority government-wide each year as a result of sequestration or the reduction of discretionary spending limits under BBEDCA.

Recommendation: In order to reduce the administrative costs associated with a fragmented MAI grant structure that diminishes the effective use of HHS's limited HIV/AIDS funding, and to enhance services to minority populations, HHS should consolidate disparate MAI funding streams into core HIV/AIDS funding during its budget request and allocation process.

Recommendation: Congress should consider strengthening the current consumer privacy framework to reflect the effects of changes in technology and the marketplace--particularly in relation to consumer data used for marketing purposes--while also ensuring that any limitations on data collection and sharing do not unduly inhibit the economic and other benefits to industry and consumers that data sharing can accord. Among the issues that should be considered are: (1) the adequacy of consumers' ability to access, correct, and control their personal information in circumstances beyond those currently accorded under FCRA; (2) whether there should be additional controls on the types of personal or sensitive information that may or may not be collected and shared; (3) changes needed, if any, in the permitted sources and methods for data collection; and (4) privacy controls related to new technologies, such as web tracking and mobile devices.
