Comments: DOD concurred with the recommendation. The Department stated that it would seek fiscal year 2020 funds to contract a study on DOD contract financing policies and their effect on the defense industry. In September 2020, DOD stated that this action would be completed by December 31, 2021. The first phase of the report is estimated to be completed September 30, 2021. The department secured funds to complete the study and a contract was awarded on April 23, 2020.

Recommendation: The Under Secretary of Defense for Research and Engineering should ensure that the Director, MDA revises MDA policies to require that all integrated capabilities--capabilities that require integration of two or more elements--be included in a Technical Capability Declaration. (Recommendation 1)

Comments: DOD partially concurred with this recommendation. While DOD agreed with the intent of this recommendation, DOD stated that the MDA Director will determine which major integrated capabilities should be delivered via the Technical Capability Declaration (TCD) process. MDA also noted that it is updating MDA Directive 5000.17 (estimated release in 4Q FY2020), which is intended to address this recommendation. GAO will assess the revisions when they are available. We continue to believe that in order for the agency to meet the full intent of our recommendation, it should establish in policy, a clear, definitive standard for which capabilities require a TCD delivery.

Recommendation: The Under Secretary of Defense for Research and Engineering should ensure that the Director, MDA clarifies, in written policy, the exact requirements, process, and key milestones necessary to issue a Technical Capability Declaration, including a requirement that the Assessment Requirements Review be held in such a time frame that it can provide meaningful input to MDA's test plans. (Recommendation 2)

Comments: DOD concurred with this recommendation and contends that its new Policy Memorandum 90 meets the intent of our recommendation. However, this new Policy Memorandum leaves open the possibility of continued inconsistent application of the Technical Capability Declaration (TCD) process. In order for the agency to meet the full intent of our recommendation, MDA should establish in policy, a clear, definitive standard for which capabilities require a TCD for delivery that should be tracked over several years to ensure that the policy is followed. MDA officials noted that revisions to MDA Directive 5000.17 expected at the end of Fiscal Year 2020 will address the recommendation. We will assess the new parameters set out in the revised policy directive, when it is available. We will also continue to track how MDA implements any new policies on TCDs and whether the information is transparent.

Recommendation: The Under Secretary of Defense for Research and Engineering should ensure that the Director, MDA includes information on current undefinitized contract actions in the BMDS Accountability Report, including the not-to-exceed price, the definitization schedule, the amount of funds obligated for the undefinitized period, and any changes since the contract action was entered into. (Recommendation 3)

Comments: DOD concurred with this recommendation and has taken steps to implement it. While we noted in our report that the BMDS Accountability Report for 2018, approved by the MDA Director on March 9, 2018 reflected that the agency had taken steps to implement this recommendation, we plan to leave this recommendation open to ensure that the BMDS Accountability Report accurately contains all undefinitized contract actions that the agency enters into through the fiscal year and whether the reporting contains the information necessary to satisfy our recommendation.

Recommendation: The Under Secretary of Defense for Research and Engineering should ensure that the Director, MDA, ensures that models used for operational tests are validated and accredited for such assessments. To help achieve this, MDA should provide the BMDS Operational Test Agency all evidence previously agreed to and needed to accredit models before ground testing events, as specified in the BMDS OTA accreditation plan. (Recommendation 4)

Comments: DOD concurred with this recommendation and stated that MDA is actively working with the BMDS Operational Test Agency (BMDS OTA) to resolve any issues associated with, and the reporting of, modeling limitations. However, according to BMDS OTA officials, while the number of accredited models has risen in recent years, some remain unaccredited. We, therefore, believe it is premature to closeout this recommendation but we will continue to track MDA's progress on taking the necessary steps to implement this recommendation.

Recommendation: The Under Secretary of Defense for Research and Engineering should ensure that the Director, MDA includes in capability delivery packages, such as the Technical Capability Declaration memos and Operational Capability Baseline change packages, the following: a. The verification, validation, and accreditation status of the models used in operational ground tests; and b. Modeling and simulation limitations that affect operational ground test results. (Recommendation 5)

Comments: DOD concurred with our recommendation and has taken steps to address it. For example, in April 2018, the department developed a template for the military departments to use to identify specific types of information to collect. Since then, each of the military departments has initiated or planned to initiate efforts to collect and analyze information about outcomes of incentive contracts. In addition, in July 2020 DOD provided examples of selected DOD, Army, and Navy incentive contracts documented in the template previously noted. The department did not provide additional information about the Air Force's efforts, or about how DOD is analyzing the information to determine whether incentives can achieve desired outcomes. GAO has ongoing work to review DOD's use of fixed-price type contracts--including fixed-price incentive contracts--for major DOD systems, which may provide additional insights related to this recommendation.

Recommendation: To strengthen management of the Direct Loan Program and ensure good customer service for borrowers, the Secretary of Education should direct the Office of Federal Student Aid's Chief Operating Officer to review its methods of providing instructions and guidance to servicers, identifying areas to improve clarity and sufficiency, and ensure consistent delivery of instructions and guidance to ensure program integrity and improve service to borrowers. For example, the Department could consider implementing a detailed, common servicing manual for the Direct Loan program.

Comments: The Department of Education agreed with this recommendation and reviewed its process for providing guidance to servicers. It has issued a few clarifications to servicers to help with consistency and reported that it intends to incorporate this recommendation into its acquisition plan for a new loan servicing system. To fully implement this recommendation, the agency needs to demonstrate that the new Direct Loan servicing system will provide clear and consistent instructions and guidance to servicers to ensure program integrity and improve service to borrowers. As of February 2020, Education officials said implementation of this recommendation was still in progress, pending completion in October 2021. At that time, the agency expects the re-design of its student loan financial services environment, which will include additional guidance to servicers, to be fully operational.

Recommendation: To gain visibility and enable efficient management on the use of bridge contracts in federal agencies, the Administrator of OFPP should take appropriate steps to develop a standardized definition for bridge contracts and incorporate it as appropriate into relevant FAR sections.

Comments: Staff from the Office of Federal Procurement Policy (OFPP) had previously told us that OFPP would be convening the FAR Council to discuss regulatory action after it completes the development of management guidance. In January 2020, OFPP staff stated that they are reviewing the extent to which this guidance is necessary moving forward, and noted that there is no estimated timeframe for completion of this review. However, in August 2020, OFPP staff said that in light of the focus on COVID and related priorities, OFPP does not have immediate plans to pursue guidance on bridge contracting at this time. OFPP staff noted that OFPP continues to work with agencies to help them effectively leverage acquisition flexibilities that reduce Procurement Acquisition Lead Times to reduce the need for bridge contracts. We continue to believe these actions are important to help ensure agencies do not continue to use these noncompetitive contracts frequently or for prolonged periods of time, thereby risking paying more than they should for goods and services .

Recommendation: To gain visibility and enable efficient management on the use of bridge contracts in federal agencies, the Administrator of OFPP should, as an interim measure, until the FAR is amended, provide guidance to agencies on (1) a definition of bridge contracts, with consideration of contract extensions as well as stand-alone bridge contracts; and (2) suggestions for agencies to track and manage their use of these contracts, such as identifying a contract as a bridge in a Justification and Approval (J&A) when it meets the definition, and listing the history of previous extensions and stand-alone bridge contracts back to the predecessor contract in the J&A.

Recommendation: Until such time that DOD is able to accurately project contractor FTE estimates it presents in budget submissions using the inventories and required reviews, the Secretary of Defense should direct the Under Secretary of Defense (Comptroller) to include an explanation in annual budget exhibits of the methodology used to project contractor FTE estimates and any limitations of that methodology or the underlying information to which the methodology is applied.

Comments: DOD partially concurred with this recommendation and stated in its agency comments that it will strengthen the annual guidance as improvements are made in the inventory of contracted services. Further, DOD stated that if a component's methodology deviates from the process defined in the annual guidance, a footnote explaining the deviation will be included in the contracted services section of the Operation and Maintenance Overview book within the budget. The department could not provide any evidence of steps taken in response to this recommendation, as such we consider this recommendation to be open.
