    Recommendation: To strengthen agency performance measurement related to deterring child smuggling, the Secretary of Homeland Security should instruct DHS's U.S. Immigration and Customs Enforcement to establish annual performance targets associated with the performance measures it has established for its Transnational Criminal Investigative Units.

    Comments: In its comments on the report in July 2015, the Department of Homeland Security stated that it concurred with this recommendation, and that it would work with host nation partners to establish goals to measure these units' investigative activities and capacity development. In September 2015, DHS noted that it planned to use law enforcement data to measure TCIU success rates and inform efforts going forward. In November 2017 DHS officials told GAO that the department planned to develop performance targets associated with the performance measures it has established for these units. However, as of January 2018, DHS has not yet completed this effort.

    Recommendation: The Secretary of Transportation should direct the Administrator of NHTSA to identify actions--in addition to the agency's currently planned efforts--to support state efforts to increase public awareness of the dangers of drug-impaired driving. This effort should be undertaken in consultation with ONDCP, HHS, state highway-safety offices, and other interested parties as needed.

    Comments: NHTSA met with ONDCP, HHS, and GHSA in March 2016 and discussed what consumer research has been done and education materials have been used in raising awareness for the drug-impaired driving issue. NHTSA completed marijuana creative concept focus group market research in the Fall of 2016; however, the findings from this research were inconclusive. NHTSA plans to determine next steps and develop a new strategy in communicating on this challenging topic by Spring 2017. NHTSA anticipates conducting additional market research that will provide the direction for the development of creative materials by Fall 2017.

    Recommendation: To improve disposition reporting that would help states update and complete criminal history records, the Director of the FBI should task the FBI Advisory Policy Board to establish a plan with time frames and milestones for achieving its Disposition Task Force's stated goals.

    Recommendation: To better equip states to meet the regulatory requirement to notify individuals of their rights to challenge and update information in their criminal history records, and to ensure that audit findings are resolved, the Director of the FBI--in coordination with the Compact Council-- should determine why states do not comply with the requirement to notify applicants and use this information to revise its state educational programs accordingly.

    Recommendation: To help ensure that security-related funding is directed to programs that have demonstrated their effectiveness, the Secretary of Homeland Security should direct the TSA Administrator to limit future funding support for the agency's behavior detection activities until TSA can provide scientifically validated evidence that demonstrates that behavioral indicators can be used to identify passengers who may pose a threat to aviation security.

    Comments: DHS did not concur with this recommendation, but has subsequently taken steps to address it. For example, TSA reduced the number of Behavior Detection Officers (BDO) from 3,131 full-time equivalents (FTE) in fiscal years 2013 through 2015 to 2,600 BDO FTEs in fiscal year 2016 and has reduced funding for its behavior detection activities since 2013. In fiscal year 2017, TSA eliminated the standalone BDO position and began integrating BDOs and behavior detection activities into the standard duties of its transportation security officer (TSO) position. According to TSA, this adjustment resulted in $196 million in funding becoming available to support increased passenger volume at TSA's checkpoints. TSA also revised its list of behavior indicators from 94 to 36. In July 2017, however, GAO found that only 8 of the 36 revised indicators were supported by valid evidence-- which includes original research that meets generally accepted research standards and presents evidence that is applicable in supporting TSA's use of specific behavioral indicators--demonstrating the use of the indicators to identify passengers who pose a threat to aviation security. As a result, GAO reported that TSA should continue to limit funding for behavior detection activities until the agency can provide valid evidence demonstrating that behavioral indicators can be used to identify potentially high-risk passengers. GAO has ongoing work to monitor and review TSA's behavior detection activities.

    Recommendation: To ensure Ford-class carrier acquisitions are supported by sound requirements and a comprehensive testing strategy, and to promote the introduction of reliable, warfighting capable ships into the fleet, the Secretary of Defense should direct the Secretary of the Navy to take the following action prior to accepting delivery of Gerald R. Ford CVN 78. The Secretary of Defense should direct the Secretary of the Navy to conduct a cost-benefit analysis on (1) currently required capabilities, including increased sortie generation rates and reduced manning and (2) the time and money needed to field systems to provide these capabilities, in light of known and projected reliability shortfalls for critical systems. This analysis should be informed by demonstrated system performance from land-based testing, including updated reliability growth projections, and should identify trade space among competing cost, schedule, and performance parameters. The analysis should also consider whether the Navy should seek requirements relief from the Joint Requirements Oversight Council, to the extent necessary, to maximize its return on investment to the warfighter. The Navy should report the results of this analysis to Congress within 30 days of CVN 78 commissioning.

    Comments: We recommended that DOD conduct a cost-benefit analysis on currently required capabilities, and report the results to Congress within 30 days of CVN 78 commissioning. DOD agreed with our recommendation for a cost-benefit analysis, but disagreed with the timing of it, stating that it plans to measure CVN 78 capabilities through completion of operational testing after ship delivery. Since the release of our report, the Navy completed cost-benefit analyses to determine the acquisition strategy for CVN 79, making two major changes to the ship (replacing the Dual Band Radar (DBR) with a different radar solution and introducing a phased construction and delivery approach.) While these are major program changes, the department did not evaluate the fundamental reason for conducting a cost-benefit analysis, namely that known and projected reliability shortfalls make it unlikely that the program will achieve its sortie generation requirements. In December 2016, an Independent Review Team commissioned by the Under Secretary of Defense, Acquisition, Technology and Logistics completed a comprehensive assessment of the CVN 78's systems, but did not recommend any capability trade-offs or requirements relief.
    Recommendation: To ensure Ford-class carrier acquisitions are supported by sound requirements and a comprehensive testing strategy, and to promote the introduction of reliable, warfighting capable ships into the fleet, the Secretary of Defense should direct the Secretary of the Navy to take the following action prior to accepting delivery of CVN 78. The Secretary of Defense should direct the Secretary of the Navy to adjust the planned post-delivery test schedule to ensure that system integration testing is completed prior to entering initial operational test and evaluation.

    Comments: Until the Navy updates the test plan in February 2018, we will not know if it will fully address our recommendation. However, recent test schedules suggest an overlap remains between integration testing and the start of initial operational test and evaluation.
