    Recommendation: The Administrator of CMS should take immediate steps to assess and improve the data available for Medicaid program oversight, including, but not limited to, T-MSIS. Such steps could include (1) refining the overall data priority areas in T-MSIS to better identify those variables that are most critical for reducing improper payments, and (2) expediting efforts to assess and ensure the quality of these T-MSIS data.

    Recommendation: The Secretary of Education should assess and improve, as necessary, the quality of data and methods used to forecast borrower incomes, and revise the forecasting method to account for inflation in estimates.

    Comments: The Department of Education agreed to assess and improve its borrower income forecasts. The agency reported that it is working with Treasury and other federal partners to obtain the best income data while ensuring that taxpayer privacy is protected to the full extent of the law. Education noted it will establish a timeframe for improvements to the IDR model that allows for adequate and thorough analysis and quality control. It will also consider including an adjustment for inflation in our income estimates and will document the results of our analysis for the next version of the IDR model. The agency wants to guarantee that an inflation adjustment is appropriate for this subpopulation of IDR borrowers, therefore they will conduct further analysis to ensure that any inflation adjustment is appropriately incorporated into the model. The agency anticipates completing these efforts by September 29, 2017. When these efforts are complete, GAO will await documentation that Education has assessed and improved the quality of data quality and methods it uses to forecast borrower incomes, and that it has revised its forecasting methods to account for inflation.
    Recommendation: The Secretary of Education should obtain data needed to assess the impact of income recertification lapses on borrower payment amounts, and adjust estimated borrower repayment patterns as necessary.

    Priority recommendation

    Comments: The Department of Education agreed to attempt to obtain data to assess the impact of income recertification lapses on borrower payment amounts. The agency reported that it started to collect more detailed information on borrowers who fail to recertify their income. It will analyze these data to see if they can be used to adjust borrower repayment patterns in the model. The agency will also consider whether to include behavioral effects to account for targeted borrower outreach to recertify their income. GAO will monitor the progress of these efforts. Education expects to complete these efforts by September 29, 2017. At that time, GAO will await documentation that Education has obtained the necessary data to assess the impact of recertification lapses on borrower repayment patterns and adjusted estimated borrower repayments in its model, as necessary.
    Recommendation: The Secretary of Education should complete efforts to incorporate repayment plan switching into the agency's redesigned student loan model, and conduct testing to help ensure that the model produces estimates that reasonably reflect trends in Income-Driven Repayment plan participation.

    Comments: The Department of Education agreed to incorporate repayment plan switching into its redesigned student loan model, and reiterated that efforts to incorporate this capability had begun despite challenges inherent in predicting borrower behavior. GAO will monitor the progress of these efforts.
    Recommendation: The Secretary of Education should, as a part of the agency's ongoing student loan model redesign efforts, add the capability to produce separate cost estimates for each Income-Driven Repayment plan and more accurately reflect likely repayment patterns for each type of loan eligible for these plans.

    Comments: The Department of Education asserted that as they redesign its current cost estimation model, it will consider adding the capability to produce separate cost estimates for each IDR plan and allow for separate, more accurate estimates by loan type.
    Recommendation: The Secretary of Education should more thoroughly test the agency's approach to estimating Income-Driven Repayment plan costs, including by conducting more comprehensive sensitivity analysis on key assumptions and adjusting those assumptions (such as the agency's Public Service Loan Forgiveness participation assumption) to ensure reasonableness.

    Comments: The Department of Education agreed to test its approach to estimating IDR plan costs more thoroughly, including through more comprehensive sensitivity analysis. The agency included in its FY16 Annual Financial Report, sensitivity analyses for Public Service Loan Forgiveness participation and borrower incomes. In the future, the agency will consider conducting additional sensitivity to analyses as well as other kind of analysis to ensure reasonableness. GAO will consider closing this recommendation when the agency has completed these efforts.
    Recommendation: The Secretary of Education should publish more detailed Income Driven Repayment plan cost information-- beyond what is regularly provided through the President's budget--including items such as total estimated costs, sensitivity analysis results, key limitations, and expected forgiveness amounts.

    Recommendation: To make it more likely that HHS will achieve its goals to reduce quality measure misalignment and associated provider burden, the Secretary of HHS should direct CMS and the Office of the National Coordinator for Health Information Technology to prioritize their development of electronic quality measures and associated standardized data elements on the specific quality measures needed for the core measure sets that CMS and private payers have agreed to use.

    Comments: In January 2017, HHS told us that ONC and CMS are prioritizing efforts to understand challenges associated with the development and implementation of electronic clinical quality measures. However, we determined that the actions did not fully address the recommendation because they focus on efforts to understand the challenges associated with electronic clinical quality measures as opposed to efforts to prioritize their development of measures from the core measure sets that CMS and private payers have agreed to use. As of August 2017, HHS officials have not informed us of any additional actions taken to implement this recommendation. We will update the status of this recommendation when we receive additional information.
    Recommendation: To make it more likely that HHS will achieve its goals to reduce quality measure misalignment and associated provider burden, the Secretary of HHS should direct CMS to comprehensively plan, including setting timelines, for how to target its development of new, more meaningful quality measures on those that will promote greater alignment, especially measures to strengthen the core measure sets that CMS and private payers have agreed to use.

    Recommendation: To ensure that USPTO's collaborative efforts on classification help examiners find relevant prior art, USPTO should work with the European Patent Office (EPO) to identify a target level of consistency of Cooperative Patent Classification decisions between USPTO and EPO and develop a plan to monitor consistency to achieve the target.

    Comments: According to the agency's action plan, USPTO has begun ongoing meetings with EPO on quality assurance. USPTO aims to agree to a target level, develop and deploy any needed IT, and begin monitoring and implementing corrective actions by first quarter of 2019.
    Recommendation: To ensure that USPTO is able to take full advantage of its investment in new information technology tools and capabilities, USPTO should develop and periodically update a documented strategy to identify key sources of nonpatent literature for individual technology centers and to assess the optimal means of providing access to these sources, such as including them in USPTO's search system.

    Recommendation: To improve its monitoring of prior art searches and provide USPTO the ability to examine and address trends in prior art search quality at the technology center level, USPTO should develop written guidance on what constitutes a thorough prior art search within each technology field (i.e., mechanical, chemical, electrical), technology center, art area, or art unit, as appropriate, and establish goals and indicators for improving prior art searches.

    Recommendation: To improve its monitoring of prior art searches and provide USPTO the ability to examine and address trends in prior art search quality at the technology center level, USPTO should ensure that sufficient information is collected in reviews of prior art searches to assess the quality of searches at the technology center level, including how often examiners search for U.S. patents, foreign patents, and nonpatent literature.

    Comments: According to the agency's action plan, USPTO will complete an evaluation of the master review form used to collect information on prior art search by April 2017 and will have performed a sufficient number of reviews by September 2017 to assess search quality at the technology center level.
    Recommendation: To improve its monitoring of prior art searches and provide USPTO the ability to examine and address trends in prior art search quality at the technology center level, USPTO should use the audits and supervisory reviews to monitor the thoroughness of examiners' prior art searches and improvements over time.

    Comments: According to the agency's action plan, USPTO will develop metrics for prior art search quality and processes to incorporate information learned from these metrics by June 2017.
    Recommendation: To ensure that examiners have sufficient time to conduct a thorough prior art search, USPTO should, in conjunction with implementing the recommendation from our patent quality report to analyze the time examiners need to perform a thorough examination, specifically assess the time examiners need to conduct a thorough prior art search for different technologies.

    Comments: According to the agency's action plan, USPTO will complete analyses of examiner's required duties and current time expectancies and determine what, if any, additional time should be given by September 2017.
    Recommendation: To ensure that examiners have the technical competence needed to complete thorough prior art searches, USPTO should assess whether the technical competencies of examiners in each technology center match those necessary; develop strategies to address any gaps identified, such as a technical training strategy; and establish measures to monitor progress toward closing any gaps.

    Recommendation: To improve the quality and transparency of data entered into FRPP as GSA transitions the database to a platform that would enable greater government-wide use, the Administrator of GSA, in consultation with OMB and federal agencies, should (1) assess the reliability of FRPP data by determining how individual agencies collect and report FRPP data for each FRPP field, including any supplemental guidance used by agencies to comply with government-wide FRPP data definitions as part of the annual certification of FRPP data; (2) analyze the differences in collecting and reporting practices used by these agencies; and (3) identify and make available to FRPP users the limitations of using FRPP data, in the context of how the data are intended to be used in real property decision making and to measure real property performance across agencies and update federal guidance to address limitations, as needed.

    Priority recommendation

    Comments: GSA partially agreed with the recommendation noting that it has limited resources to fully analyze and map the data relative to FRPP data definitions, and that it is the responsibility of individual agencies to ensure reliability of the data and compliance with FRPP definitions. As of October 2016, GSA has taken some action to implement this recommendation. GSA told us it has made progress by conducting an in-depth survey in June 2106 focusing on several data elements including: replacement value, status, owned and otherwise management operating costs, repair needs, utilization, and lease costs. The survey asked agencies questions regarding the processes/resources used to source and compile these data elements from agency IT systems as well as internal agency guidance. GSA received responses from 24 agencies and stated it plans to complete its initial analysis of the survey in the fall of 2016 and indicate limitations of these data elements. GSA plans to conduct a series of working group meetings with agencies to conduct an in depth review of the survey results and to develop a set of recommendations for the Federal Real Property Council. GSA said these recommendations may include, but are not limited to, altering data dictionary definitions, sharing best or common practices for reporting these data elements, and sharing the limitations on the use of these data elements. Based on the working group outcomes and input from the Federal Real Property Council and OMB, GSA plans to produce a white paper on these topics by the latter part of 2017.
    Recommendation: To enhance the usefulness of the National Strategy for managing federal real property government-wide, the Director of OMB should expand the National Strategy to further address long-standing real property management challenges by: (1) expanding the scope to include maintenance and repair needs; (2) articulating planned actions and identifying alternative approaches, including alternative-funding mechanisms, to address underlying causes of the real property problems; (3) ensuring that performance measures at the agency level inform the overall progress of the National Strategy; and (4) determining the government-wide costs, benefits, and risks by leveraging agencies' long-term capital plans and identifying approaches to optimally manage that risk.

    Recommendation: To improve the measurement of nursing home quality, the Administrator of CMS should establish and implement a clear plan for ongoing auditing to ensure reliability of data self-reported by nursing homes, including payroll-based staffing data and data used to calculate clinical quality measures.

    Recommendation: To help ensure modifications of CMS's oversight activities do not adversely affect the agency's ability to assess nursing home quality and that effective modifications are adopted more widely, the Administrator of CMS should establish a process for monitoring modifications of essential oversight activities made at the CMS central office, CMS regional office, and state survey agency levels to better understand the effects on nursing home quality oversight.

    Recommendation: To help ensure the completeness and accuracy of cost and cost-related data for maintenance dredging contracts in the Corps' Dredging Information System database, the Secretary of Defense should direct the Director of Civil Works of the U.S. Army Corps of Engineers to require that its district offices establish systematic quality controls to regularly verify the completeness and accuracy of their maintenance dredging contract data, including processes for ensuring that corrections are made when errors or omissions may be identified, such as through headquarters reviews.

    Recommendation: In order to strengthen investment decisions, place the chosen investments on a sound acquisition footing, provide a better means of tracking investment progress, and improve the management and transparency of the U.S. missile defense approach in Europe, the Secretary of Defense should direct MDA's new Director to add risk reduction non-intercept flight tests for each new type of target missiles developed.

    Comments: Despite partially concurring with our recommendation in 2013, MDA has not adjusted its test plans to include risk-reduction (i.e., non-intercept) flight tests for new target types prior to their inclusion in an intercept flight test. MDA officials have not done so because such decisions must be balanced against potential cost, schedule, and programmatic impacts and flight test preparation processes, like dry-runs and quality control checks, are sufficient to discover issues prior to an intercept test. While test preparation processes are valuable, they are not a substitute for risk reduction flight tests. This was proven in June 2015 when MDA launched a new intermediate-range target that had 6 different test preparation processes but not a risk-reduction flight test and the target failed, which resulted in significant cost, schedule, and programmatic impacts. Moving forward, despite the impacts from its recent target failure, MDA plans to use a new medium-range target during its third, and most complex operational test in the second quarter of fiscal year 2019. We maintain our stance that risk reduction flight tests would reduce the risk for the associated test and the overall flight test plan; however, MDA's action to-date suggest that it has no intention of including risk-reduction flight tests for new targets. However, we will continue to monitor its progress in this regard.
    Recommendation: In order to strengthen investment decisions, place the chosen investments on a sound acquisition footing, provide a better means of tracking investment progress, and improve the management and transparency of the U.S. missile defense approach in Europe, the Secretary of Defense should direct MDA's new Director to include in its resource baseline cost estimates all life cycle costs, specifically the operations and support costs, from the military services in order to provide decision makers with the full costs of ballistic missile defense systems.

    Priority recommendation

    Comments: DOD partially concurred with our recommendation that decisionmakers should have insight into the full lifecycle costs of MDA's programs. However, as of August 2017, MDA is still not including the military services' operations and sustainment costs--which are a part of the full lifecycle costs--in the resource baselines it reports in the Ballistic Missile Defense System Accountability Report. MDA is trying to determine how to report the full lifecycle costs to decisionmakers, but has indicated that the Ballistic Missile Defense System Accountability Report is not the appropriate forum for reporting the military services' operation and support costs. We continue to believe that including the full lifecycle costs of MDA's programs enables decisionmakers to make funding determinations that are based on a comprehensive understanding of the depth and breadth of each program's costs.
    Recommendation: In order to strengthen investment decisions, place the chosen investments on a sound acquisition footing, provide a better means of tracking investment progress, and improve the management and transparency of the U.S. missile defense approach in Europe, the Secretary of Defense should direct MDA's new Director to stabilize the acquisition baselines, so that meaningful comparisons can be made over time that support oversight of those acquisitions.

    Comments: DOD concurred with our recommendation regarding the need for MDA to stabilize its acquisition baselines, but also noted MDA's need to adjust its baselines to remain responsive to evolving requirements and threats; both of which are beyond MDA's control. Further, DOD highlighted the MDA Director's authority to make adjustments to the agency's programmatic baselines, within departmental guidelines. Our recommendation, however, is not designed to limit the Director's authority to adjust baselines or to prevent adjusting baselines as appropriate. Rather, our recommendation is designed to address traceability issues we have found with MDA's baselines, which are within its control. Specifically, for MDA to be able to effectively report longer-term progress of its acquisitions and provide the necessary transparency to Congress, it is critical that the agency stabilize its baselines so that once set, any revisions can be tracked over time. At this point we have not seen any indication that MDA is working to implement this recommendation. For example, in 2016, MDA's Director made changes to the Targets and Countermeasures program's baseline that omit the costs of some targets and may make tracking progress against prior years and the original baseline very difficult, and in some instances, impossible.     Recommendation: To help ensure the longer-term compliance of nursing homes that have successfully returned to substantial compliance under temporary management, the Administrator of CMS should develop guidance for states to enhance their oversight of such homes, such as implementing reactivation of temporary management if the home does not maintain substantial compliance over the 2 years following the conclusion of the sanction.

    Comments: September 2017: CMS provided documentation of training documents developed for State Agency Directors and Enforcement Specialists covering a variety of topics including when to use the temporary management sanction. Neither the new training nor relevant sections of the CFR or State Operations Manual appear to provide guidance on longer-term oversight of nursing homes that have returned to substantial compliance under temporary management. September 2016: GAO has not received additional information from CMS. July 2015: CMS indicated it will provide GAO with updated actions in early 2016. July 2014: CMS said the recommendation was in process and CMS was drafting an internal enforcement action plan to discuss enforcement remedies including temporary management. June 2013: CMS officials said they have been making an effort to work with the Regional Offices and states on the appropriate use of all sanctions in general, including the use of Temporary Management. June 2012: CMS officials said that the agency continues to investigate the various uses of CMP monies and the potential to use CMPs to recruit, train and supervise temporary managers is one of several options under consideration. May 2011: CMS agreed this was an important recommendation, but due to the Affordable Care Act implementation, the agency said they temporarily deferred planned work until 2012.

    Recommendation: To improve the Bureau's use of its master schedule to manage the 2020 decennial census, the Secretary of Commerce should require the Director of the U.S. Census Bureau to include estimates of the resources, such as labor, materials, and overhead costs, in the 2020 integrated schedule for each activity as the schedule is built, and prepare to carry out other steps as necessary to conduct systematic schedule risk analyses on the 2020 schedule.

    Comments: Commerce neither agreed nor disagreed with this recommendation. The Bureau continues to refine its 2020 Census master schedule, which it recently announced it completed in July 2016. Bureau officials have periodically described their intent to link resources to activities within their schedules, but as of July 2016 had confirmed that it had not yet done so. The Bureau has provided us with copies of its schedule, but not yet satisfactory evidence of having completed such an analysis. We are beginning an audit of the Bureau's scheduling practices this summer and will review actions the Bureau may have taken to address this recommendation. As of July 2017, we have received initial documents as we begin this review.

    Recommendation: Given the potential for improving compliance now and in the future, Congress may wish to provide IRS with the authority to use math error checks to identify and correct returns with ineligible (1) IRA "catch-up" contributions, and (2) contributions to traditional IRAs from taxpayers over age 70-1/2.

    Recommendation: Congress may wish to consider amending CSB's authorizing statute or the Inspector General Act of 1978 to permanently give Environmental Protection Agency's (EPA) Inspector General the authority to serve as the oversight body for the agency.
