A firm protested the National Park Service's (NPS) rejection of its bid and subsequent contract award for sludge dewatering equipment, contending that: (1) NPS unreasonably evaluated its bid; and (2) the awardee's bid did not comply with the Buy American Act. GAO held that: (1) NPS properly rejected the protester's bid as nonresponsive, since its descriptive literature showed that its proposed equipment did not meet the solicitation specifications; and (2) the awardee's compliance with the Buy American Act concerned a matter of responsibility which GAO would not review absent evidence of fraud or bad faith. Accordingly, the protest was denied.
