A firm claimed reimbursement for protest preparation costs under a Defense Logistics Agency (DLA) solicitation. GAO had dismissed the protest as academic, since DLA subsequently cancelled the contract award pending its reevaluation of the protester's bid. GAO held that it had no basis for allowing the claim, since it had not determined that DLA did not comply with applicable statutes and regulations. Accordingly, the claim was denied.
