The Equal Employment Opportunity Commission (EEOC) requested a decision regarding whether employees on furlough status before and after a paid holiday would be entitled to pay for that holiday. GAO held that: (1) by placing employees on furlough, agencies temporarily changed the status to one without duties or pay; and (2) if the furlough included the workdays preceding and succeeding a holiday, there was no presumption that they would have worked on the holiday. Accordingly, EEOC should not pay employees for a holiday when it occurs while they are on furlough.
