A Department of Labor employee appealed the Claims Group's denial of his claim for backpay, contending that he was due backpay because Labor failed to upgrade his position. GAO held that: (1) a memo from a Labor official did not constitute a reclassification of the position since it did not conform with the technical classification recommendations of the appropriate personnel officials; and (2) the employee was entitled only to the salary of his assigned position, regardless of the duties performed. Accordingly, the denial was sustained.
