WE HAVE YOUR LETTERS OF MAY 4 AND JULY 18, 1957, REQUESTING RECONSIDERATION OF YOUR CLAIM FOR DAMAGE TO PROPERTY ADJOINING ARTILLERY PARK, FORT BROOKE, PUERTO RICO, WHICH CLAIM WAS THE SUBJECT OF OUR SETTLEMENT OF APRIL 18, 1957.

IN OUR SETTLEMENT YOUR ATTENTION WAS DIRECTED TO THE ACT OF OCTOBER 9, 1940, 54 STAT. 1061 (31 U.S.C. 71A), WHICH BARS ALL CLAIMS AGAINST THE UNITED STATES COGNIZABLE BY THE GENERAL ACCOUNTING OFFICE UNLESS RECEIVED IN OUR OFFICE WITHIN 10 YEARS OF THE DATE THE CLAIM FIRST ACCRUED.

IN YOUR LETTER OF FEBRUARY 29, 1956, TO THE CORPS OF ENGINEERS YOU SAY THAT THE BUILDINGS ALLEGEDLY CAUSING THE DAMAGE TO YOUR PROPERTY WERE ERECTED IN 1944 OR 1945. SINCE THE TEN-YEAR PERIOD REFERRED TO IN THE CITED ACT EXPIRED IN 1954 OR AT THE LATEST IN 1955, AND YOUR CLAIM WAS NOT RECEIVED IN OUR OFFICE UNTIL FEBRUARY 7, 1957, YOUR CLAIM APPEARS FOREVER TO BE BARRED AND WE ARE PRECLUDED BY LAW FROM ALLOWING ANY AMOUNT ON ITS ACCOUNT. THE ACTION TAKEN IN DISALLOWING YOUR CLAIM IS THEREFORE SUSTAINED.
