Congress requested GAO's opinion on the proviso in the Interior Department Appropriation Act of 1949, which stipulates that any person who performs the duties of Commissioner of Reclamation, Assistant Commissioner of Reclamation, or Regional Director of Reclamation must be a qualified engineer with at least five years' engineering administrative experience. Any persons not meeting these requirements may not be paid out of the appropriation contained in the act. However, the Commissioner of Reclamation and a Regional Director of Reclamation have been unable to meet these qualifications, but have retained their positions serving without pay since January 31, 1949.
