A firm protested an Army contract award, contending that the Army should have rejected the awardee's bid, since it: (1) misrepresented itself when it failed to furnish complete information regarding its debarments, suspensions, and responsibility; and (2) was not a responsible contractor. GAO held that: (1) the awardee did not intentionally mislead the Army regarding its performance history; (2) it would not review the affirmative responsibility determination, since the protester could not provide evidence of fraud or bad faith. Accordingly, the protest was dismissed.
