A firm requested reconsideration of its dismissed protest of the General Services Administration's (GSA) rejection of its expense waiver. GAO had held that the protester untimely filed its protest after bid opening. In its request for reconsideration, the protester contended that the dismissal improperly implied that its offer was not a fixed-price proposal. GAO held that: (1) its dismissal was based on the fact that GSA told the protester before the closing date that it would not consider an expense waiver in the bid evaluation; and (2) the protest was properly dismissed as untimely. Accordingly, the request for reconsideration was denied.
