A firm requested reconsideration of its dismissed protest of a Department of Veterans Affairs (VA) solicitation for portable chemical analyzers and related equipment. GAO had held that the protester was not sufficiently interested to protest the solicitation, since it would not be in line for award even if its protest was sustained. In its request for reconsideration, the protester contended that: (1) GAO would have considered its protest had it not submitted a bid; and (2) it would have offered a substantially lower bid price if VA had issued reasonable functional specifications. GAO held that: (1) the protester submitted a bid despite its challenge to the solicitation; and (2) there was no evidence that the protester was prejudiced by the brand name specifications, since the protested specifications did not have a material impact on the protester's price. Accordingly, the request for reconsideration was denied.
