A firm protested an Army contract award for waterway guidewall construction, contending that the Army: (1) improperly determined that the awardee's bid was responsive; and (2) mistakenly assumed that the Buy American Act did not apply to the procurement. GAO held that the: (1) protester's contention that the Army considered the Act inapplicable was based solely on the inaccurate statement of an unauthorized Army employee; (2) protester failed to provide a valid basis of protest; and (3) protester untimely filed after bid opening its protest of alleged solicitation improprieties. Accordingly, the protest was dismissed.
