A firm protested the Navy's rejection of its bid for lift station repairs, contending that the Navy: (1) improperly determined that its bid was nonresponsive; and (2) should have waived the discrepancy in its bid bond as a minor informality. GAO held that the: (1) protester's bid bond was of questionable enforceability because there was a significant discrepancy in the surety's and power of attorney's signatures; (2) discrepancy in the protester's bid bond and power of attorney was material to the solicitation and could not be waived; and (3) Navy properly rejected the protester's bid as nonresponsive. Accordingly, the protest was dismissed.
