A firm protested a Department of Energy (DOE) subcontract award for computer systems, contending that: (1) DOE improperly applied a price differential to its bid based on provisions of the Buy American Act; and (2) the awardees did not offer systems with the requisite Federal Communications Commission certification. GAO held that the: (1) DOE prime contractor made an improper determination regarding the domestic status of the awardees' equipment without considering the place of manufacture for the products; and (2) protester untimely filed its protest concerning product certification. Accordingly, the protest was sustained in part and dismissed in part.
