A firm protested the Army nonappropriated fund instrumentality's (NAFI) rejection of its bid for hotel renovation and operation, contending that GAO had jurisdiction over the procurement, since the NAFI officials were acting as agents for the Army. GAO held that: (1) it did not have jurisdiction to review the procurement, since the procurement was not conducted by the Army; (2) the protester failed to provide evidence that the Army's involvement in the procurement was pervasive; and (3) NAFI was not a federal agency under procurement protest regulations. Accordingly, the protest was dismissed.
