[Army Reservist's Request for Waiver of Indebtedness]

An Army reservist requested waiver of indebtedness for an erroneous payment of unused accrued leave incident to his voluntary separation from active duty, contending that he lost his unused leave time due to the leave carry-over limitation. GAO held that the claimant was entitled to an indebtedness waiver, since he: (1) lost his unused leave, due to the carry-over limitation; and (2) filed his request for waiver within 3 years of the erroneous payment. Accordingly, waiver was granted.
