A former Navy member claimed payment for 25 days of unused leave. The claimant contended that she was entitled to payment for the leave because: (1) she properly accrued it; (2) a Navy official advised her that she was entitled to payment for all accrued leave; and (3) she worked on 3 days for which she was charged leave. GAO held that the claimant was not entitled to payment for remaining leave, since: (1) reimbursement for unused leave could not exceed 60 days over the course of service; (2) misinformation concerning leave did not establish a basis for unallowable reimbursement; and (3) while the matter of the improperly charged leave was one for the Navy to consider, the claimant could not be paid for any additional unused leave. Accordingly, the claim was denied.
