A firm protested an Army contract award for fuzes, contending that, since no domestic firm was capable of manufacturing an acceptable fuze, a Buy American evaluation factor was applicable to all bids. GAO held that: (1) since the awardee certified that it would supply a domestic product, the evaluation factor was not applicable to its bid; (2) it would not review the Army's affirmative responsibility determination absent circumstances not applicable to the instant protest; and (3) the awardee was obligated to supply a domestic product. Accordingly, the protest was denied.
