The Department of Health and Human Services (HHS) requested a decision concerning its authority to make retroactive overtime payments to its employees at the Gillis W. Long Hansen's Disease Center. GAO held that HHS could grant retroactive overtime pay to the employees, since such payment would be consistent with congressional intent under a statutory provision that allowed overtime compensation for the employees. Accordingly, HHS may pay retroactive overtime compensation.
