A carrier requested a review of the General Services Administration's (GSA) disallowance of its supplemental claim for transportation costs for a Navy shipment. GSA had paid the carrier's original transportation charges, but disallowed the supplemental bill for charges on the grounds that the carrier's exclusive-use rule was ambiguous and inconsistent with other provisions in its tender. GAO held that the carrier's tender provisions were not ambiguous, since they conformed to the carrier's intent and to the Navy's understanding. Accordingly, the GSA action was overruled and the claim was allowed.
