A firm requested reconsideration of the dismissal of its protest under a Department of Labor solicitation. GAO had held that the protester failed to timely file comments on Labor's protest report. In its request for reconsideration, the protester contended that: (1) in its comments it misstated the date it received the report; (2) it timely filed its comments because GAO never notified it in writing of its telephonic request for a conference; and (3) GAO should consider the protest because it presented significant issues. GAO held that: (1) it would not reconsider the protest on the basis of information that was available to the protester when it filed its comments; (2) the telephonic request for a conference had no bearing on the protester's failure to timely file comments; and (3) it would not consider the protest under its significant issues rules because the protest was not untimely filed. Accordingly, the dismissal was affirmed.
