CONTRACTS - PROTESTS - INTERESTED PARTY REQUIREMENT - PROTESTER NOT IN LINE FOR AWARD DIGEST: PROTESTS ARE DISMISSED WHERE PROTESTERS ARE NOT NEXT IN LINE FOR AWARD IF PROTESTS ARE SUSTAINED. HAVE PROTESTED THE AWARD OF A CONTRACT FOR "DOT MATRIX PRINTERS" TO SYSTEMS. THE PROTESTERS HAVE RAISED SEVERAL TECHNICAL ISSUES ABOUT THE ACCEPTABILITY OF SYSTEMS' EQUIPMENT. WE WILL NOT CONSIDER THESE ISSUES AS WE HAVE LEARNED FROM FACTS REPORTED BY THE VA THAT THE PROTESTERS ARE NOT "INTERESTED PARTIES" UNDER OUR BID PROTEST REGULATIONS. IF A BIDDER OR OFFEROR WOULD NOT BE NEXT IN LINE FOR AWARD OF THE CONTRACT IN QUESTION IF THE PROTEST WERE UPHELD. IT IS NOT AN INTERESTED PARTY. VA REPORTS THAT NONE OF THE PROTESTERS ARE NEXT IN LINE FOR AWARD SHOULD SYSTEMS BE EXCLUDED FROM CONSIDERATION.

COMSEL CORP., INNOVATIVE COMPUTER LEASING, INC., GALAXY DISTRIBUTING, INC., AND PACIFIC MOUNTAIN STATES CORP. HAVE PROTESTED THE AWARD OF A CONTRACT FOR "DOT MATRIX PRINTERS" TO SYSTEMS, TERMINALS, & COMMUNICATIONS CORP. (SYSTEMS) BY THE VETERANS ADMINISTRATION (VA) UNDER REQUEST FOR PROPOSALS (RFP) 101-21-85.

THE PROTESTERS HAVE RAISED SEVERAL TECHNICAL ISSUES ABOUT THE ACCEPTABILITY OF SYSTEMS' EQUIPMENT. HOWEVER, WE WILL NOT CONSIDER THESE ISSUES AS WE HAVE LEARNED FROM FACTS REPORTED BY THE VA THAT THE PROTESTERS ARE NOT "INTERESTED PARTIES" UNDER OUR BID PROTEST REGULATIONS. SEE 4 C.F.R. SECS. 21.0(A) AND 21.1(A) (1985).

IF A BIDDER OR OFFEROR WOULD NOT BE NEXT IN LINE FOR AWARD OF THE CONTRACT IN QUESTION IF THE PROTEST WERE UPHELD, IT IS NOT AN INTERESTED PARTY. SEE GRACON CORPORATION, B-219663, OCT. 22, 1985, 85-2 CPD PARA. 437. VA REPORTS THAT NONE OF THE PROTESTERS ARE NEXT IN LINE FOR AWARD SHOULD SYSTEMS BE EXCLUDED FROM CONSIDERATION. CONSEQUENTLY, WE DISMISS THE PROTESTS.
