The Department of Labor (DOL) recommended that a firm and its owner, individually, be placed on the ineligible bidders list for violations of the Davis-Bacon Act. DOL reported that: (1) employees were not paid the minimum wages required pursuant to the act; (2) certified payroll records were falsified; and (3) employees were not paid overtime compensation at the rate prescribed by the Contract Work Hours and Safety Standards Act. GAO found that: (1) the contractor disregarded its obligations to its employees under the act; (2) the underpayment of employees was intentional as demonstrated by the firm's falsification of certified payroll records and constituted a substantial violation of the act; and (3) falsification of payroll records is a basis for debarment under the Davis-Bacon Act. Accordingly, the firm and its owner will be included on the debarred bidders list.
