A freight carrier requested reconsideration of a decision which affirmed a Claims Group settlement denying its claim for reimbursement of an amount taken to satisfy an Air Force claim for property allegedly lost during shipment by the carrier. The Claims Group had concluded that a prima facie case of carrier liability was established which the carrier failed to rebut. Along with its request for reconsideration, the carrier submitted two copies of the Government bill of lading for the shipment which established that no loss occurred in transit. GAO stated that, in the absence of any evidence to refute this showing, the protester's claim was allowable. Accordingly, the prior decision was reversed, and the Claims Group was advised to issue a settlement certificate allowing the claim.
