An advance decision was requested concerning the propriety of payment of travel claims submitted by employees of the Army Corps of Engineers who were ordered to transport Government-owned drilling rigs from one site to another. The first employee left with a rig on a Friday, remained midtransit for the weekend, and completed the journey on a Monday. The employee was ordered to stay where he did for the weekend by his supervisors because it was more cost effective to pay the employee per diem rather than overtime for the weekend. GAO stated that, where an employee's traveltime is extended because it would be less costly to the Government and not for the employee's personal convenience, a 2-day limitation on per diem does not apply. Accordingly, the employee could be paid per diem for the weekend. The other employee drove a vehicle from his temporary duty station to his permanent duty station and remained midtransit for a weekend because he had not been authorized overtime status for weekend travel. Since the holdover was based upon orders to avoid overtime work, the 2-day limitation on per diem did not apply. GAO found that this employee also could be paid per diem for the weekend.
