The Nuclear Regulatory Commission (NRC) requested reconsideration of a decision denying reimbursement to a professional institute for expenses it incurred in preparing to carry out an abandoned NRC testing program. GAO had held that NRC could not reimburse the claimant because NRC did not benefit from the activities for which it sought payment. GAO held that: (1) NRC failed to provide additional information to show that it received any benefit from the proposed program; and (2) although the claimant provided information to NRC, that did not justify reimbursement because NRC did not carry out the program. Accordingly, the original decision was affirmed.
