A Navy disbursing office requested an advance decision as to whether a commissioned officer could elect not to occupy the government quarters assigned to him while on temporary duty and receive a basic allowance for quarters during this period. The ship on which the officer was performing temporary duty and to which he would later be permanently assigned was in its home port. The officer was ordered to additional temporary duty on a second ship prior to a permanent change of station to the first ship. GAO found that, according to Defense regulations and federal law, the officer was entitled to a basic allowance for quarters during the period in question, assuming his unit was not deployed more than 90 days. GAO also noted that the Secretary concerned may deny a member's right not to occupy government quarters and to receive a basic allowance for quarters if he determines that such an election would adversely affect military discipline or readiness. Accordingly, the voucher was returned for payment if otherwise correct.
