POWER TESTING, INCORPORATED:

POWER TESTING, INCORPORATED (POWER TESTING) PROTESTS THE AWARD OF A CONTRACT TO ENERGY SYSTEMS MAINTENANCE, INC. (ESMI) UNDER INVITATION FOR BIDS (IFB) NO. 3-87091 ISSUED BY THE NATIONAL AERONAUTICS AND SPACE ADMINISTRATION (NASA) FOR THE MAINTENANCE AND REPAIR OF HIGH VOLTAGE ELECTRICAL POWER SYSTEMS AT THE LEWIS RESEARCH CENTER IN CLEVELAND, OHIO. FOR THE FOLLOWING REASONS POWER TESTING'S PROTEST IS DISMISSED IN PART AND DENIED IN PART.

POWER TESTING MAINTAINS THAT THE IFB WAS DEFECTIVE AND SHOULD BE CANCELED BECAUSE IT FAILED TO CONTAIN A WAGE DETERMINATION UNDER THE SERVICE CONTRACT ACT. IN THIS REGARD, POWER TESTING ASSERTS THAT THE DEPARTMENT OF LABOR (DOL) IMPROPERLY REFUSED TO ISSUE A WAGE DETERMINATION FOR THE CLASS OF EMPLOYEES COVERED BY THE CONTRACT WHEN REQUESTED TO DO SO BY NASA ON THE BASIS THAT NO EXISTING WAGE DETERMINATION WAS IN EFFECT AND THAT THERE WAS NOT A SUFFICIENT NUMBER OF EMPLOYEES INVOLVED TO WARRANT A WAGE DETERMINATION FOR ONLY THE SUBJECT CONTRACT. POWER TESTING CONTENDS THAT DOL WAS IN ERROR AND THAT A WAGE DETERMINATION BASED ON THE PREVAILING RATE PAID CONSTRUCTION WORKERS SHOULD HAVE BEEN USED.

OUR BID PROTEST PROCEDURES REQUIRE THAT PROTESTS BASED UPON ALLEGED SOLICITATION DEFECTS WHICH ARE APPARENT ON THE FACE OF THE SOLICITATION BE FILED EITHER WITH THE CONTRACTING AGENCY OR OUR OFFICE PRIOR TO BID OPENING. SEE 4 C.F.R. SEC. 20.2(B)(1) (1980). THOSE PROCEDURES ALSO PROVIDE THAT ONCE A PROTEST HAS BEEN FILED WITH THE CONTRACTING AGENCY ANY SUBSEQUENT PROTEST TO OUR OFFICE MUST BE FILED WITHIN 10 WORKING DAYS OF ACTUAL OR CONSTRUCTIVE KNOWLEDGE OF INITIAL ADVERSE AGENCY ACTION, E.G., DENIAL OF THE PROTEST. SEE 4 C.F.R. SEC. 20.2(A). ALTHOUGH POWER TESTING RAISED ITS OBJECTIONS REGARDING THE ABSENCE OF A WAGE DETERMINATION WITH NASA PRIOR TO THE OCTOBER 29, 1979 BID OPENING, IT DID NOT FILE ITS PROTEST WITH OUR OFFICE UNTIL DECEMBER 17 LONG AFTER NASA SENT IT A LETTER INDICATING THAT THE SOLICITATION WOULD NOT BE REVISED. CONSEQUENTLY, THE PROTESTER'S OBJECTIONS REGARDING THE ABSENCE OF A WAGE DETERMINATION WILL NOT BE CONSIDERED.

POWER TESTING ALSO CONTENDS ESMI DOES NOT HAVE THE PERSONNEL TO COMPLY WITH THE MINIMUM EXPERIENCE REQUIREMENTS OF THE IFB'S STATEMENT OF WORK AND THUS ITS BID SHOULD BE REJECTED AS NONRESPONSIVE. SPECIFICALLY, POWER TESTING ALLEGES THAT THE EMPLOYEES ESMI INTENDS TO USE DO NOT SATISFY SECTION F OF THE STATEMENT OF WORK WHICH REQUIRES THE CONTRACTOR TO USE A FOREMAN WITH "FIVE YEARS EXPERIENCE AS A JOURNEYMAN HIGH VOLTAGE ELECTRICIAN PLUS A MINIMUM OF ONE (1) YEAR (EXPERIENCE) AS A FOREMAN" AND ELECTRICIANS WITH FIVE YEARS EXPERIENCE AS "HIGH VOLTAGE ELECTRICIANS."

WE DO NOT AGREE THAT ESMI'S BID WAS NONRESPONSIVE. A BID IS RESPONSIVE IF, AS SUBMITTED IT CONSTITUTES AN OFFER TO PERFORM WITHOUT EXCEPTION, THE EXACT THING CALLED FOR IN THE IFB, AND UPON ACCEPTANCE WILL BIND THE BIDDER TO PERFORM IN ACCORDANCE WITH ALL THE MATERIAL TERMS AND CONDITIONS OF THE IFB. SEE 49 COMP.GEN. 553, 556 (1970). HERE, ESMI'S BID DID NOT TAKE EXCEPTION TO ANY MATERIAL TERMS OF THE IFB. HENCE, ESMI'S BID WAS RESPONSIVE AND THAT FIRM IS OBLIGATED TO PERFORM IN ACCORDANCE WITH THE MATERIAL TERMS OF THE IFB, INCLUDING SECTION F OF THE STATEMENT OF WORK.

TO THE EXTENT POWER TESTING IS QUESTIONING ESMI'S ABILITY TO PERFORM THE CONTRACT IN ACCORDANCE WITH ITS TERMS, I.E., ESMI'S RESPONSIBILITY, THAT PORTION OF THE PROTEST IS DISMISSED AS WE DO NOT REVIEW AFFIRMATIVE DETERMINATIONS OF RESPONSIBILITY EXCEPT WHERE ACTIONS BY PROCURING OFFICIALS ARE TANTAMOUNT TO FRAUD OR WHERE THE SOLICITATION CONTAINS DEFINITIVE RESPONSIBILITY CRITERIA WHICH ALLEGEDLY HAVE NOT BEEN APPLIED. PREVENTIVE HEALTH PROGRAMS, B-195846, FEBRUARY 20, 1980, 80-1 CPD 144. THERE IS NO INDICATION HERE OF FRAUD ON THE PART OF NASA AND THE REQUIREMENTS OF SECTION F OF THE STATEMENT OF WORK DO NOT CONSTITUTE DEFINITIVE CRITERIA OF RESPONSIBILITY. DEFINITIVE CRITERIA OF RESPONSIBILITY ARE THOSE REQUIREMENTS WHICH A CONTRACTOR IS REQUIRED TO ESTABLISH THAT IT MEETS PRIOR TO THE AWARD OF A CONTRACT. PREVENTIVE HEALTH PROGRAMS, SUPRA. THE EXPERIENCE PROVISIONS OF SECTION F ARE PERFORMANCE REQUIREMENTS; THEY DO NOT ESTABLISH AN EXPERIENCE STANDARD WITH WHICH THE BIDDER, AS A CONDITION OF AWARD, MUST DEMONSTRATE COMPLIANCE. ACCORDINGLY, POWER TESTING'S ALLEGATIONS REGARDING ESMI'S ABILITY TO PERFORM THE CONTRACT IN ACCORDANCE WITH SECTION F OF THE STATEMENT OF WORK WILL NOT BE CONSIDERED.

THE PROTEST IS DISMISSED IN PART AND DENIED IN PART.
