A firm protested the rejection of its bid as nonresponsive because a cover letter enclosed with its bid stated that the company did not believe the Service Contract Act should apply to the procurement. It was held that since the invitation for bids stated that the Service Contract Act would be applicable, the company should have protested prior to bid opening. In addition, the company's letter with its bid was considered a protest to the agency and was therefore untimely, since a protest of an alleged solicitation impropriety filed with the bid package is not timely filed before bid opening. The protest was therefore dismissed.
