The Federal Bureau of Investigation (FBI) asked whether an employee was entitled to real estate expenses for the sale of his residence incident to his change of duty station after an interim training period. The real estate sale occurred shortly before a previous GAO decision entitling Federal employees to the expenses. A recent GAO decision held that the prior decision applied retroactively. Therefore, since the facts in the incident case were the same, GAO held that the employee was entitled to the real estate expenses for the sale of his residence.
