A Navy member appealed the denial of waiver of his debt which arose out of erroneous payments of basic allowance for quarters (BAQ). The member received a lump-sum payment for retroactive payment of BAQ at the "with dependent rate" and subsequent increases in his pay although he had indicated that his spouse, another member, was not a dependent. The member should have known that payments were erroneous since there was no scheduled salary increase or change in his status for the period of payments; the waiver may not be granted in spite of the fact that he had made inquiries.
