A company protested the award of a contract to a competitor by the Naval Air Development Center. The protester contended that the awardee's bid was nonresponsive and that the procurement and the contract violated legislation. The Navy disclaimed any ambiguity in the invitation for bids. While the solicitation should have provided instructions for recovery of nonrecurring costs, the failure to do so did not result in any reasonable ambiguity as to the bid prices intended by either bidder. The question of whether the contract violated the Anti-Deficiency Act was untimely. The protest was dismissed in part and denied in part.
