A company protested its rejection by the Air Force, contending that the selection board failed to evaluate it in accordance with the criteria set forth by the synopsis in the Commerce Business Daily which requested the submission of qualifications by interested firms. The protest was sustained since the contracting agency admitted that certain evaluation factors used in selecting the firms were too vague, and since the evaluation did not provide for the required consideration of factors affecting equitable distribution of contracts. The company also requested that it be allowed to participate in the agency's efforts to clarify regulations regarding selection, to review the awardee's design, and to receive a copy of the agency's instructions regarding inspections of the procuring office's practices. These requests were not appropriate for consideration under the GAO bid protest function. The company's claim for anticipated profits and expenses incurred in pursuing the protest was denied since no legal basis existed for payment. The protest was sustained, and the claim denied, accordingly.
