An advance decision was requested concerning the computation of a lump-sum payment for annual leave and rates of payment for an employee who had gone on leave without pay to accept a position with a congressional committee and later resigned from the agency. The employee's right to a lump-sum payment accrued at the date of separation. He was not entitled to within-grade increases during his nonpay status and his pay rate may not be adjusted upward based on the highest previous rate rule. His annual leave balance in excess of 240 hours was forfeited and his sick leave balance would be recredited if he were reemployed within 3 years from separation. The lump-sum payment did not violate the limitation on dual compensation.
