A member of the uniformed services who is seperated from her spouse (also a member) and has custody of their child to whose suport the father is to contribute pursuant to a seperation agreement, is entitled to basic allowance for quarters (BAQ) at the with dependents rate (WDR) because: (1) the member who does not have custody can receive BAQ at the WDR without regard to the child; and (2) the member with custody contributes substantially to the child's support.
